Social Competition Terms
- [March] [2023] mySimbaSleep promotion
- The prize draw is open to all UK residents aged 18 years or over, except employees of the Promoter, their families, agents or any third party directly associated with administration of the prize draw.
- The prize draw is free to enter and no purchase is necessary.
- Prospective entrants must capture an image of their new Simba mattress, with the Simba flag device logo visible either on the mattress or the mattress’ packaging, including no other identifiable brands in the image, with the hashtag “#mySimbaSleep”.
- Prospective entrants must post the image described in condition 3 to Instagram (the “Platform”) via a public (not private) post on a public (not private) profile on the Platform. Entries must be posted on ‘grid’ or permanent profile feeds (i.e. not on a ‘Stories’ or other disappearing format). Posts which disappear after 24 hours will not be tracked and collected by Simba. The image must remain public until not earlier than 23:59 GMT on the Draw Date defined in condition 8 to facilitate the Promoter’s validation of the entry.
- Only one entry per household is permitted.
- The opening date for entries is [09:00] on [14 March 2023]. The closing date of the prize draw is [23:59] on [31 March 2023]. Entries received after this time will not be considered.
- The Promoter accepts no responsibility for entries not successfully completed due to a technical fault technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
- A winner will be chosen by random draw performed by a computer process at [11:00] on [05 April 2023] ("Draw Date"). When a random entry is selected during the draw on the Draw Date, the entry selected will be checked to confirm that at conforms with the entry requirements specified above. If the selected entry does not conform with the requirements specified above, the draw process will be repeated until a conforming entry is selected.
- The winner will receive 2 Simba Pillows and a Simba Duvet of the winner’s choice (any size) delivered to the address of their choice within the UK.
- The winner will be notified via a direct message via their profile on the Platform before [7 April 2023] and must provide a postal address in the UK to claim their prize. If a winner does not respond to the Promoter within 3 days of being notified by the Promoter, then the winner's prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.
- The prize will be sent to the winner by post within 7 days of being notified of their win.
- The prize for the winner is non-exchangeable, non-transferable and no cash alternative is offered. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.
- The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.
- The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the first initial, surname and county of prize winners on the Promoter’s website, at www. simbasleep.com/pages/simba-competition-winners If you object to any or all of your surname, county and winning entry being published, please contact the Promoter via hello@simbasleep.com. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
- Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.
- The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so.
- Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
- By submitting an entry, each entrant grants and assigns a perpetual, irrevocable, royalty-free, non-exclusive licence to edit, publish, translate, modify, adapt, post, repost, make available and distribute the entry throughout the world in any media now known or hereafter invented, to the Promoter, and to the Promoter's subsidiaries, licencees, and agents. Each entrant also confirms that anyone depicted in an entry has given their permission for the inclusion of their image in the entry and the use of the entry including their image by the entrant and the Promoter, and to the Promoter's subsidiaries, licencees, and agents. See also condition 14 with regard to the announcement of winners.
- These terms and conditions and this promotion are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
