Simba Sleep Tech Sale Promotion Terms and Conditions
1.1 This Promotion (Simba Sleep Tech Sale Promotion) is subject to these Simba Sleep Tech Sale Terms and Conditions (Simba Sleep Tech Sale Terms), promoted by Simba Sleep Limited, UK company 9703422 (Simba), and these Simba Sleep Tech Sale Terms are subject to the overarching terms and definitions set out in of Simba's general Terms set out at www.simbasleep.com/pages/terms/ (Simba General Terms), including, but not limited to, the application of Collective Discounts where applicable.
1.2 To the extent that the definition and the application of a Third Party Offer in these Simba Sleep Tech Sale Terms conflict with the Simba General Terms in respect of combining promotional discounts, these Simba Sleep Tech Sale Terms prevail.
1.3 In these Simba Sleep Tech Sale Terms, the following defined terms are used;
1.3.1 All capitalised terms defined in the Simba General Terms appearing in these Sleep Tech Sale Terms have the meanings as defined therein.
1.3.2 Promotional Window – means the limited time between 09:00 BST on 23/09/2024, to 23:59 BST on 30/09/2024 only.
1.3.3 Promotional Price, and Promotional Pricing – means the price, and the offer pricing, respectively, for Products offered on the Website during the Promotional Window subject to this Simba Sleep Tech Sale Promotion.
1.3.4 Typical Price, and Typical Pricing – means the typical price, and the typical pricing respectively, for Products of various lines and models offered on the Website during the Typical Pricing Window.
1.3.5 Typical Pricing Window – means a period prior to the Promotional Window during which Typical Pricing was offered on the Website, commencing on 02/09/2024 and concluding on 22/09/2024.
1.3.6 Joint Promoter – means entities trading as GoCertify, Blue Light Card, Jointnetwork, Myvouchercodes NHS, Vouchercodes NHS, Student Beans, UNIDAYS, Totum, Save the Students, and Defence Discount Service, each of which offer a Third Party Offer which is available to Consumer Group members eligible for Collective Discounts under the Simba General Terms.
1.3.6.1 Joint Promoter Terms Document – means the document setting out specific additional terms pursuant to which a Joint Promoter and Simba may offer to members of a Consumer Group an Extra Offer.
1.3.7 Extra Offer – means various promotional offers which may be available to You, as set out in a Joint Promoter Terms Document, if You are a member of a Consumer Group eligible for a Collective Discount under the Simba General Terms through one of the Joint Promoters listed in these Simba Sleep Tech Sale Terms subject and pursuant to the relevant promotional offer terms which the respective Joint Promoters advance via their websites or “widget” or other integrations on our Website as applicable, which specifically reference a Third Party Offer Exemption which must be included in our Website’s operating promotional terms and conditions (these Simba Sleep Tech Sale Terms being such promotional terms and conditions and meeting that definition) as distinct from being mentioned in the Simba General Terms.
1.3.8 Selected Mattresses – Essential, Inter, Hybrid Original, Pro, Luxe, Ultra, Source, Escape, Apex line mattresses, other than refurbished mattresses from those lines, are Selected Mattresses.
1.3.9 Selected Beds – all beds offered for sale on the Website during the Promotional Window other than Orion, Atlas, Lomond, and Platform bed lines, and any refurbished beds from any line, are Selected Beds.
1.3.10 Combination – means a pre-configured or user selected group of 2 or more Products offered on the Website in which one or more of the Products making up the Combination is eligible for a Combination Product Discount when the Products are bought by You concurrently via the Website as part of a Combination. More information about Combinations is explained in these Simba Sleep Tech Sale Terms’ term 3.3’s various subterms.
1.3.11 Combination Product Discount – means a price reduction applicable to an individual Product sold as new when that individual Product is purchased concurrently with one or more other Products, which is discounted on an individual basis when purchased in such a Combination, defined and subject to these Simba Sleep Tech Sale Terms, including as set out in these Simba Sleep Tech Sale Terms’ term 3.3’s various subterms.
1.3.11.1 A Product not so listed in these Simba Sleep Tech Sale Terms’ term 3.3’s various subterms in respect of a Combination Product Discount reduction against Typical Pricing Window Pricing and any associated qualifications or exclusions is not eligible for a Combination Product Discount.
1.3.12 Bundle – means a pre-configured or user selected group of 2 or more Products offered on the Website which, when the Products are bought by You concurrently via the Website as part of a Bundle, are offered at a combined price.
1.3.13 Bundle Discount - means a price reduction applicable to the combined price of Products sold as new, which is discounted on a combined basis when purchased in such a Bundle, defined and subject to these Simba Sleep Tech Sale Terms, including as set out in these Simba Sleep Tech Sale Terms’ term 3.4’s various subterms.
1.3.13 Blended Offer – means;
1.3.13.1 Any Combination and any Combination Product Discounts therewith associated; or
1.3.13.2 Any Bundle and any Bundle Discount therewith associated.
1.4 To ensure wide ranging availability of our Products to as many consumers as possible during the course of the Simba Sleep Tech Sale Promotion, and without limiting our other options under the Simba General Terms, where what Simba regards to be excessive quantities of Products of not dissimilar specification are ordered in one order, or across multiple orders using contact, payment, and/or delivery information in common across those multiple orders, then without notice, Simba may refuse any such order or orders, or Simba may decline to fulfill such order or orders.
What promotional discounts are available during Promotional Window and how are these displayed on the Website?
2.1 During the Simba Sleep Tech Sale Promotion, various reductions to the price of certain Products comparing the Promotional Price of those products with the Typical Price of those Products will apply, as set out in clause 3 below.
2.2 The Promotional Prices will be displayed on the Website during the Promotional Window.
2.2.1 In conjunction with the Promotional Pricing or otherwise, Typical Pricing for Products of not dissimilar specification may also be displayed on the Website during the Promotional Window for comparison purposes.
2.3 The Promotional Prices apply when You purchase individual Products or any Specified Combination of Products offered on the Website subject to certain terms and conditions.
How are savings, discounts, and comparisons displayed on the Website during the Simba Sleep Tech Sale Promotion calculated?
3.1 Discounts and savings for Selected Mattresses on the Website explained: The discounts and savings described for Selected Mattresses on the Website during the Promotional Window are based on comparison with the prices of individual new Selected Mattresses of not dissimilar specification offered on the Website, being the price at which those Products of not dissimilar specification were sold to consumers on the basis described during the Typical Pricing Window, compared with the Promotional Pricing.
3.1.1 The discounts and savings described in term 3.1 for Selected Mattresses vary by model and size, and vary from a minimum 15% saving or discount compared in respect of a Selected Mattress of a not dissimilar specification with the Typical Pricing Window, to a maximum 23% saving or discount compared in respect of a Selected Mattress of a not dissimilar specification with the Typical Pricing Window.
3.1.2 The Selected Mattress discount in respect of any Selected Mattress Product sold as new and benefitting from a Selected Mattress Discount on an individual basis cannot be combined with a Combination Product Discount for a Selected Mattress set out at these Simba Sleep Tech Sale Terms’ term 3.3.3.
3.2 Discounts and savings for Selected Beds on the Website explained: The discounts and savings described for Selected Beds on the Website during the Promotional Window are based on a comparison with the prices of individual new Selected Beds of not dissimilar specification offered on the Website, being the price at which those Products of not dissimilar specification were sold to consumers on the basis described during the Typical Pricing Window, compared with the Promotional Pricing.
3.2.1 The discounts and savings described in term 3.2 for Selected Beds vary by model, size, and various configuration options where applicable, and vary from a minimum £35.00 saving or discount compared in respect of a Selected Bed of a not dissimilar specification with the Typical Pricing Window to a maximum £255.00 saving or discount compared in respect of a Selected Bed of a not dissimilar specification with the Typical Pricing Window.
3.3 Discounts and savings for Products contained with a Combination of selected new Products offered on the Website explained: The discounts and savings described for a constituent Combination Discount Product within a group of Products constituting a Combination of new Products on the Website during the Promotional Window is based on a comparison of the price of the given Product or Products which comprise a Combination Product Discount component Product or Products of a Combination offered during the Promotional Window, compared with the prices at which the new constituent Combination Discount Products of not dissimilar specification was offered on an individual basis, on the Website during the Typical Pricing Window, being the price at which those individual Products of not dissimilar specification were sold to consumers on the basis described during the Typical Pricing Window comparing the given Combination Discount Product with the Typical Pricing Window’s Typical Pricing.
3.3.1 The Combination Product Discount in respect of any pillow sold as new in a Combination as set out in term 3.3 is a 20% saving or discount in respect of a pillow of a not dissimilar specification.
3.3.2 The Combination Product Discount in respect of any duvet sold as new in a Combination as set out in term 3.3 is a 20% saving or discount in respect of a duvet of a not dissimilar specification.
3.3.3 The Combination Product Discount in respect of any Selected Mattress sold as new in a Combination is a 20% saving or discount in respect of a Selected Mattress of a not dissimilar specification.
3.3.3.1 The Combination Product Discount in respect of any Selected Mattress sold as new and benefitting from a Combination Product Discount cannot be combined with any other discount on a Selected Bed, including, but not limited to, the discount set out at these Simba Sleep Tech Sale Terms’ term 3.1.
3.3.4 The Combination Product Discount in respect of any Selected Bed imports the Selected Bed discount in respect of the given Selected Bed, which are described in these Simba Sleep Tech Sale Terms’ term 3.2.
3.4 Discounts and savings for Products sold at a combined price in a Bundle of selected new Products offered on the Website explained: The discounts and savings described in respect of a group of Products constituting a Bundle of new Products on the Website during the Promotional Window is based on a comparison of the combined price of the Bundle offered during the Promotional Window, compared with the prices at which the new, individual constituent Products of not dissimilar specification comprising the said Bundle were offered on an individual basis, on the Website during the Typical Pricing Window, being the price at which those individual Products of not dissimilar specification were sold to consumers on the basis described during the Typical Pricing Window comparing the given Products with the Typical Pricing Window’s Typical Pricing.
3.4.1 The discounts and savings applicable to a given Bundle under term 3.4 necessarily depend on the constituent Products within a Bundle, and savings and discounts available across the many potential configurations of Bundles available will vary widely accordingly. 3.5 While we have exerted our best endeavours to make all information about Products available for use in and benefiting from the associated savings or discount applicable to each Blended Offer which is available clear on the Website via our checkout journey, not all Products on the Website may be available for use as, or offered for sale as constituent Products (whether or not subject to a Combination Product Discount in a Combination, or as one or more constituent Product or Products in a Bundle) in a Blended Offer. What are the conditions and exclusions applicable to the Simba Sleep Tech Sale Promotion?
4.1 Other than an Extra Offer, any other promotion, discount, or offer cannot be combined with the Simba Sleep Tech Sale Promotion unless expressly permitted by this clause 4.1’s subclauses.
4.1.1 These Simba Sleep Tech Sale Terms allow an Extra Offer as defined in these Simba Sleep Tech Sale Terms to be used during the Simba Sleep Tech Sale Promotion subject to the specific terms and any other exclusions or limitations applicable to an Extra Offer offered by a Joint Promoter listed in these Simba Sleep Tech Sale Terms.
4.1.2 The maximum discount any Extra Offer may result in will amount to a total discount of 21% off the Typical Pricing Window price of an individual Product, and the redemption of this discount additionally depends on the specific terms set out in the relevant Simba and Joint Promoter’s separate promotional terms document, as well as the Simba General Terms.
4.1.3 For the avoidance of doubt, neither a Bundle nor a Combination Product Discount as defined in these Simba Sleep Tech Sale Terms’s term 1.3.10 may be combined with an Extra Offer.
4.2 Any discount or promotional offer within these Simba Sleep Tech Sale Terms is not redeemable for cash, credit or any other alternative.
4.3 The Simba Sleep Tech Sale Promotion is offered only in respect of purchases of Products made available for purchase by consumers via the Simba Website, and for delivery to an address in the UK only, and where available pursuant to the Simba General Terms.
4.4 For the avoidance of doubt in respect of any Blended Offer;
4.4.1 where any Blended Offer is constituted by Products being purchased concurrently by You, and another price reduction is offered under these Simba Sleep Tech Sale Terms or otherwise, in respect of not dissimilar Products, and the price reduction offered under a Blended Offer differs from a price reduction otherwise offered, the highest discount or saving Blended Offer which You commenced building in your shopping cart, or which was in your shopping cart, should be applied automatically;
4.4.2 more than one Blended Offer may potentially be applicable to multiple Products included within a Blended Offer by virtue of multiple Products eligible for a Blended Offer being constituent parts of one or more Blended Offers; and
4.4.3 only one Blended Offer and associated saving, discount, or reduction to pricing pursuant to these Simba Sleep Tech Sale Terms shall be applied on a per individual Product basis.
In what situations may Simba adjust or end the Simba Sleep Tech Sale Promotion?
5.1 The Simba Sleep Tech Sale Promotion is offered pursuant to Simba’s good will and is offered only for so long as Simba elects to offer it or any element of it, and contingent on Simba being in compliance with, and remaining compliant with, legal and other obligations.
5.1.1 Simba reserves the right to take any action whatsoever in respect of the Simba Sleep Tech Sale Promotion where Simba considers that it is appropriate to do so.
5.1.2 By way of non-exhaustive examples, Simba reserves the right to cancel, adjust, amend, or withdraw at any time and without notice;
5.1.2.1 this Simba Sleep Tech Sale Promotion in its entirety; or
5.1.2.2 any particular individual or Combination or Bundle offer or any other offer, discount, or saving promoted pursuant to it, whether in part or in full, from availability; or
5.1.2.3 any Product or Combination of Products or Bundle of Products, from availability.

5.2 Simba may elect to act under term 5.1 and the subterms thereof in any circumstances, including, but not limited to, in circumstances where Simba;
5.2.1 has regard to its legitimate business interests; or
5.2.2 is or suspects Simba may be prevented from administering this Simba Sleep Tech Sale Promotion or any component of it in accordance with these Simba Sleep Tech Sale Promotion Terms, or the Simba General Terms; or
5.2.3 is required to do so owing to a compliance or legal obligation.
5.3 Where Simba takes or omits to take any action under term 5.2 resulting in your inability to access any offer under these Simba Sleep Tech Sale Terms, Simba shall have no liability to You..
Important information about Joint Promoters and Extra Offers.
6.1 Joint Promoters may advance certain Extra Offers to You via various channels, subject to Joint Promoter Terms Documents, which interact with, and must be interpreted in conjunction with, these Simba Sleep Tech Sale Terms and the Simba General.
6.2 As not all users of the Website are members of Consumer Groups, specific comparisons of pricing for savings and discounts, or savings and discounts more generally applicable during the Promotional Window which may be available to Consumer Group members during the Promotional Window may not be displayed on the Website. You must note this when seeking to use any Extra Offer.
6.3 If You have an eligibility query about an Extra Offer based on a Consumer Group matter, You must contact the relevant Joint Promoter in the first instance.
