Simba Christmas Giveaway 2024 Terms and Conditions

1.1 This Promotion (Christmas Giveaway Promotion) is subject to these Simba Christmas Giveaway Terms and Conditions (Christmas Giveaway Terms), promoted by Simba Sleep Limited, UK company 9703422 (Simba), and these Christmas Giveaway Terms are subject to the overarching terms and definitions set out in of Simba's general Terms set out at www.simbasleep.com/pages/terms/ (Simba General Terms), including, but not limited to, the application of Collective Discounts where applicable.

1.2 In these Christmas Giveaway Terms, the following defined terms are used;

1.2.1 All capitalised terms defined in the Simba General Terms appearing in these Christmas Giveaway Terms have the meanings as defined therein.

1.2.2 Offer Window – means the limited time between 0001 GMT on 03/12/24, to 0859 GMT on 24/12/24 only.

1.2.3 Selected Mattresses – Hybrid Original, Hybrid Pro, Hybrid Luxe, Hybrid Ultra, Earth Apex, Earth Escape, Earth Source, line mattress Products, other than refurbished mattresses from those lines, are Selected Mattresses.

1.2.3.1 For the avoidance of ambiguity, Cot Bed Mattress Products and Kids Mattress Products are excluded from the definition of a Selected Mattress.

1.2.4 Christmas Giveaway Free Product Offers – each of the distinct offers set out more particularly in and subject to the terms of terms 2.1 through 2.3 and subterms thereof, inclusive.

1.2.5 Joint Promoter – means entities trading as GoCertify, Blue Light Card, Jointnetwork, Myvouchercodes NHS, Vouchercodes NHS, Student Beans, UNIDAYS, Totum, Save the Students, and Defence Discount Service, each of which offer a Third Party Offer which is available to Consumer Group members eligible for Collective Discounts under the Simba General Terms.

1.2.6 Joint Promoter Terms Document – means any document setting out specific additional terms pursuant to which a Joint Promoter and Simba may offer to members of a Consumer Group an Extra Offer, as displayed on the Joint Promoter’s website, or via “widget” or other integrations linked out from our Website as applicable.

1.3 To ensure wide ranging availability of our Products to as many consumers as possible during the course of the Promotion, and without limiting our other options under the Simba General Terms, where what Simba regards to be excessive quantities of Products of not dissimilar specification are ordered in one order, or across multiple orders using contact, payment, and/or delivery information in common across those multiple orders, then without notice, Simba may refuse any such order or orders, or Simba may decline to fulfill such order or orders.

What offers are available during the Offer Window and how are these displayed on the Website?

2.1 During the Christmas Giveaway Offer Window, when You place a Selected Mattress in your shopping cart on the Website, certain free items may be added to Your cart automatically on the Website, as part of the various Christmas Giveaway Free Product Offers, depending on the Selected Mattress’ size and model.

2.2 In respect of a given Selected Mattress and depending on the size, various different configurations of free Products may be placed in your shopping cart automatically subject to the provisions of this term 2.2’s sub-terms, each of which will constitute a separate Christmas Giveaway Free Product Offer;

2.2.1 For Hybrid Original and Earth Source Products which are Selected Mattresses, You may have a free Hybrid Pillow Product added to your cart.

2.2.2 For Hybrrid Pro and Earth Escape Products which are Selected Mattresses, You may have a free Hybrid Pillow product, and a mattress protector Product,  added to your cart.

2.2.3 For Hybrid Luxe, Hybrid Ultra, and Earth Apex Products which are Selected Mattresses, You may have a free Hybrid pillow Product, a mattress protector Product, and a Hybrid Duvet Product added to your cart.

2.2.4 In respect of all Selected Mattress Products, any mattress protector Product and/or any Duvet Product claimed will be of the same size as the Selected Mattress Product You added to your shopping cart.

2.2.5 In respect of all Selected Mattress Products of a size larger than size single, You may have an additional free Hybrid Pillow Product added to your cart.

2.3 The various Christmas Giveaway Free Product Offers will be displayed on the Website during the Offer Window on relevant Selected Mattress Product pages.

2.4  While we have exerted our best endeavours to make all information about Products available for use in and benefiting from the associated offers applicable to each Selected Mattress which are available clear on the Website via our checkout journey, not all Products on the Website may be available for use in the Christmas Giveaway Free Product Offers. Please try adding the Products which interest You to your shopping cart instance, and where this does not achieve the intended outcome, email us at hello@simbasleep.com and we will do our best to assist you.

What are the conditions and exclusions applicable to the Promotion?

4.1 The Christmas Giveaway Free Product Offers offered during the Promotion cannot be combined with any discount, or any other offer or promotion.

4.1.2 For the avoidance of ambiguity, the Christmas Giveaway Free Product Offers do not benefit from a Third Party Offer Exemption, and the Christmas Giveaway Free Product Offer  including, but not limited to, Collective Discounts or any offer advanced by any Joint Promoter regardless of what any Joint Promoter Terms Document may state.

In what situations may Simba adjust or end the Promotion?

5.1 The Promotion is offered pursuant to Simba’s good will and is offered only for so long as Simba elects to offer it or any element of it, and contingent on Simba being in compliance with, and remaining compliant with, legal and other obligations.

5.1.1 Simba reserves the right to take any action whatsoever in respect of the Promotion where Simba considers that it is appropriate to do so.

5.1.2 By way of non-exhaustive examples, Simba reserves the right to cancel, adjust, amend, or withdraw at any time and without notice;

5.1.2.1 this Promotion in its entirety; or

5.1.2.2 eligibility of any Selected Mattress, or Product relevant to one or more Christmas Giveaway Free Product Offers relevant under term 2.2, for use in any of the Christmas Giveaway Free Product Offers, whether in part or in full, from availability; or

5.1.2.3 correct or clarify typographical or drafting errors, in which circumstances a notation will be added to these Christmas Giveaway Terms following the final term to note the date of the correction or clarification.

5.2 Simba may elect to act under term 5.1 and the subterms thereof in any circumstances, including, but not limited to, in circumstances where Simba;

5.2.1  has regard to its legitimate business interests; or

5.2.2   is, or suspects Simba may be, prevented from administering this Promotion or any component of it in accordance with these Christmas Giveaway Terms, or the Simba General Terms; or

5.2.3 is required to do so owing to a compliance or legal obligation.

5.3 Where Simba takes or omits to take any action under either or any of term 5.1 or 5.2 resulting in your inability to access any offer under the Promotion per the Christmas Giveaway Terms, Simba shall have no liability to You.

6.1 In the event that free Products set out at 2.2 in respect of Selected Mattresses have not been correctly added to your cart or you experience an issue redeeming a Christmas Giveaway Free Product Offers, and You believe that You have complied with these Christmas Giveaway Terms, or You have any other questions or issues in relation to the Promotion or wish to opt out of the Promotion for any reason, please contact us via hello@simbasleep.com.
