May Survey - 23rd May 2024

We, Simba Sleep Limited (UK company Number 09703422), are inviting selected previous customers to complete an online survey (accessible via the URL https://simbaj.typeform.com/to/ExsSw4mf) to help us better understand our different customers, and their journeys in selecting and purchasing sleep products through market research (“May Customer Survey”). 

All respondents to the May Customer Survey will be entered into a competition draw to win a Simba mattress of their choice (the “Promotion”) and by submitting a response to the May Customer Survey, you accept, and agree to being bound by, the terms of that Promotion as set out below.

Terms and Conditions – May Survey Promotion Terms

1. The prize draw and process surrounding the prize draw which constitutes this Promotion is subject to these terms and conditions (“May Survey Promotion Terms”), and Simba (Simba Sleep Limited, UK company Number 09703422, registered office address 5th Floor, Halo, Counterslip, Bristol, BS1 6AJ) is the promoter of this Promotion.
2. The prize draw is free to enter, and no purchase is necessary.
3. The prize draw is open to all UK residents aged 18 years or over who were invited by Simba to complete the May Customer Survey, except employees of Simba, their families, agents or any third party directly associated with administration of the prize draw.
4. All entries must be submitted by visiting the URL https://simbaj.typeform.com/to/ExsSw4mf and fully and accurately completing the May Customer Survey accessible at that URL.
5. The opening date for entries for the prize draw is 11:00 BST on 23rd May 2024. The closing date for entries for the prize draw is 23:59 BST on 30th May 2024. Entries received after this time will not be valid.
6. Simba accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network, or server failure of any kind.
7. The use of any script, macro or any not dissimilar automated system or method, to enter the Promotion, is prohibited, and entries made (or which, in Simba’s opinion and determined at Simba’s sole discretion, appear to have been made) using any such script, macro or automated system or method, may be treated as void at Simba’s sole discretion. Any illegible, incomplete, or fraudulent entries may be rejected or held to be void
8. A single Winner will be chosen by random draw performed by a computer process on or around 4th June 2024.
9. The Winner will receive one (1) Simba Mattress of their choice of model and size, which will be delivered to an address within the UK of the Winner’s choice at Simba’s cost, subject to stock availability.
10. The Winner will be notified via contact on the afternoon of 4^th June 2024 and must provide a delivery address in the UK to claim their prize.
11. If the Winner does not respond to Simba within 3 days of being notified by the Simba, then the prize will be forfeited, and Simba will be entitled to select another Winner in accordance with the process described above
12. The Winner must communicate to Simba via email the desired delivery address for any prize as soon as reasonably practicable. The Prize will be delivered to the address specified by the Winner, provided it is within the UK, at Simba’s expense, within 30 days of the date on which the Winner confirms their preferred prize and the delivery address for the prize.
13. Entrants may only submit one entry. If Simba determines that any entrant has submitted more than one entry to the Promotion, whether such determination is made before or after a prize draw, Simba reserves the right to regard all of that entrant’s entries as invalid.
14. The prize for the Winner is non-exchangeable and non-transferable, and no cash alternative is offered.
15. Despite condition 14, Simba reserves the right to replace the Prize with an alternative prize of equal or higher value, or, and at Simba’s absolute sole discretion, the cash value of the relevant prize, if circumstances beyond Simba’s control makes it necessary to do so.
16. The decision of Simba regarding any aspect of the prize draw or administration of the Promotion is final and binding and no correspondence will be entered into about it.
17. Simba must either publish or make available information that indicates that a valid prize award took place. To comply with this obligation the Simba will send the surname and county of the prize winner to any person who writes to Simba’s registered office address (enclosing a self-addressed envelope) within one month after the closing date set out in condition 5. If you object to any or all of your surname, county and winning entry being published or made available, please get in touch with the Promoter via hello@simbasleep.com. In such circumstances, Simba must still provide the information and winning entry to the Advertising Standards Authority on request.
18. Simba reserves the right to hold void, cancel, suspend, or amend this Promotion or the May Survey Promotion Terms where it becomes necessary to do so, and/or to refuse any entry, or to refuse to award a prize to any person suspected of acting otherwise than in accordance with the May Survey Promotion Terms.
19. The Promotion and these May Survey Promotion Terms are subject to Simba’s general Terms, accessible at https://simbasleep.com/pages/terms/, and Simba’s Privacy Policy, accessible at https://simbasleep.com/pages/privacy/ (the “Simba Website Documents”). 
20. These May Survey Promotion Terms must be read in conjunction with the Simba general Simba Website Documents, as these May Survey Promotion Terms and information submitted in response to the May Customer Survey are processed pursuant to both the Simba Website Documents.
21. In the event of any conflict between these May Survey Promotion Terms and either of the Simba Website Documents, the Simba Website Documents shall take precedence over these May Survey Promotion Terms. 
22. Simba, its agents, or distributors will not in any circumstances be responsible or liable to compensate any Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
23. Personal data supplied during the Promotion will be collected and processed on the basis of your consent, so that the Promoter may conduct the Promotion (including to facilitate the award of the prize to the Winner), and for furtherance of the Promoter’s market research and business development activities as set out in the Simba Website Documents. See also condition 17 with regard to the announcement of winners.
24. These May Survey Promotion Terms and the Promotion itself are each governed by English law.
25. If any entrants to this Promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
