TERMS & CONDITIONS Review Prize Draw
- The Promoter of the Review Giveaway Prize Draw (the “Promotion”) is Simba Sleep Limited (Company Number 09703422) of 5th Floor, Halo, Counterslip, Bristol, BS1 6AJ ("Simba"). These Terms apply to individuals who participate in the Promotion (“You”). By participating, You agree to be bound by these Terms. Promotional materials relating to the Promotion, including all information on how to participate, form part of these Terms. In the event of any conflict between promotional materials and these Terms, these Terms take precedence.
- All capitalized terms defined in the Simba General Terms appearing in these Review Giveaway Prize Draw have the meanings as defined therein, and these Review Giveaway Prize Draw are subject to and must be interpreted in conjunction with both the Simba General Terms and the Simba Website Privacy Policy.
- For the purposes of these Terms, "Reviewable Product" refers to any physical goods or items available for purchase on the Simba website being Products as defined in the Simba General Terms, as well as certain service offerings (such as special delivery options) that are treated as distinct offerings.
- The Promotion is a rolling monthly prize draw, referred to each month as the “[Month Name] Review Giveaway Prize Draw.” Each draw occurs in the first week of every calendar month for entries in the preceding calendar month. Simba reserves the right to modify or terminate the Promotion with notice. If a winner does not accept the prize within the specified timeframe of 7 days (a week), an alternate winner will be selected using the same randomised process.
- The Promotion is open to UK residents aged 18 or over, except employees of the Promoter, their families, agents, or any third party associated with its administration, except where prohibited by law.
- Upon purchasing a Simba Reviewable Product, customers will receive an email inviting them to leave a review via the platform “Yotpo” and once the review is submitted, customers will be automatically entered into the prize draw.
- Each Reviewable Product review submitted via Yotpo in response to an invitation counts as one entry into the prize draw in the month in which the review is created. Customers may enter multiple times by submitting reviews for each Reviewable Product purchased, including multiple entries within the same order or across separate orders made at different times, provided that a review is left in response to an invitation advanced via email from Yotpo.
- The Promotion begins on 18th November 2024 and will run as a series of monthly prize draws (each being the “[Month Name] Review Giveaway Prize Draw”) until Simba withdraws, modifies, or terminates the Promotion. Each monthly draw is conducted independently, with entries resetting at the start of each calendar month. Simba reserves the right to modify or terminate the Promotion at any time without prior notice.
- The Promoter accepts no responsibility for entries not successfully completed due to technical malfunctions, including hardware or software failures, satellite, network or server failures of any kind. In the case of technical issues preventing entry, the Promoter is not responsible for any incomplete entries.
- Three winners will be chosen by random draw, performed by a computer process, on the first week of every calendar month ("Draw Date") for the preceding calendar month’s entries.
- Each winner will receive a prize consisting of a cash award equivalent to the full order cost for the order which included the Reviewable Product they reviewed. If a winning entry is based on a Reviewable Product within an order containing multiple items (including Products or services offerings charged at the product level which were not reviewed), the prize will include a cash award equivalent to the entire order cost, including the reviewed Reviewable Product.
- Winners will be notified by email via hello@simbasleep.comduring the week following the Draw Date of each monthly draw. Winners must respond within 7 days of notification to confirm acceptance to process the prize. If a winner does not respond within 7 days, the winner's prize will be forfeited, and the Promoter will be entitled to select an alternate winner through the process described above.
- The prize will be processed within 30 days of the winner accepting the prize. In cases where the prize cannot be processed as a refund to each winner through the original payment method, the Promoter may request the winner's bank details to complete the transfer of the cash prize.
- The prize for each winner is non-exchangeable and non-transferable. Three winners will be selected each month as part of the ongoing monthly prize draws.
- The decision of the Promoter regarding any aspect of the prize draw and the prize winners is final and binding and no correspondence will be entered into about it.
- To comply with regulatory requirements, the Promoter must publish or make available information indicating that a valid award took place. The Promoter will publish winners' surnames and counties on Simba’s website. Entrants may object to their surname and county being published by contacting the Promoter at hello@simbasleep.com. However, the Promoter must still provide this information to the Advertising Standards Authority upon request.
- By entering the Promotion, participants are deemed to have accepted and agreed to be bound by these Terms and Conditions. The Promoter reserves the right to refuse entry or refuse to award the prize to anyone in breach or suspected by the Promoter of being in breach of these Terms and Conditions.
- The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so.
- Insofar as permitted by law, the Promoter, its agents or distributors will not be liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
- Personal data supplied during the course of this Promotion will be processed only as set out in the Promoter's Privacy Policy. See condition 16 regarding the announcement of winners. By participating in the Promotion, Participants consent to the processing of their personal data as necessary to facilitate their entry, verify eligibility, and award prizes.
- The Promoter will receive information from the review platform Yotpo, confirming that a review has been submitted by a Participant. This information will include only the details necessary to identify the review and the associated purchase, enabling the entry to be included in the prize draw.
- Participants must note that interacting with the Yotpo website or services offered by Yotpo is in accordance with Promoter's Privacy Policy and the policies of Yotpo.
- Information will be shared between the Promoter and the Yotpo platform not otherwise than in accordance with the Promoter's Privacy Policy and the policies of Yotpo to administer the Promotion, including to facilitate the proper award of any prize by the Promoter.
- Participants’ surnames and counties may be published on the Promoter's website to meet regulatory requirements. Participants may object to this publication by contacting the Promoter; however, this information may still be disclosed to regulatory authorities (e.g., the Advertising Standards Authority) upon request.
- These terms and conditions and this promotion are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
