Simba Sleep x Gen M Instagram Giveaway 2024 - Competition T&Cs 

  1. The Promoter of this prize draw is Simba Sleep Limited of 5 th floor, Halo, Counterslip, Bristol, BS1 6AJ, United Kingdom

  2. The prize draw is open to all UK residents aged 18 years or over, except employees of the Promoter, their families, and agents or any third party directly associated with the administration of the prize draw.

  3. The prize draw is free to enter, and no purchase is necessary.

  4. To enter, participants must use their account on the Instagram platform to complete four steps; (1) “follow” each of the @simbasleep Instagram account, and the @genm_official Instagram account; (2) like the GIVEAWAY post on the Instagram platform; (3) tag one Instagram Friend in the Instagram post’s comments under the “GIVEAWAY” post on the Instagram platform; and (4) share the “GIVEAWAY” post on their own Instagram story for an extra entry.

  5. To enter the competition, participants must complete the first three steps set out in clause 4 via the Instagram platform. Participants must comply with Instagram’s terms and conditions as may be applicable to them. Any entries that do not fulfil one or all of the eligibility requirements set out in clause 4 at the time of prize draw will be considered invalid.

  6. The opening date for entries is 10am GMT on 27/10/2024.The closing 11:59 PM GMT on 31/10/2024.

  7. 1 winner will be chosen by a randomly generated draw performed by a computer process on 04/11/2024.

  8. The winner will receive a GenM Menopause Friendly prize bundle  consisting of a Body pillow, 2x Hybrid Pillows and 1x Hybrid Duvet in the size of the winners choice.

  9. The winner will be notified via direct message on Instagram from the @simbasleep Instagram account only. The Promoter will not use any other Instagram account to communicate with the winner.

  10. The Promoter will notify the winner not later than on 05/11/2024, and must provide a postal address in the UK to claim their prize. If a winner does not respond to the Promoter within 3 working days of being notified by the Promoter that they were a winner, then that winner's prize will be forfeited, and the Promoter will be entitled to select another winner in accordance with the process described above.

  11. The prize will be sent to each winner by post free of charge within 5 working days of being notified of their win.

  12. Delivery will be arranged for the winners by the Promoter via a third-party delivery service provider.

  13. Each prize is non-exchangeable, non-transferable and no cash alternative is offered.

  14. The Promoter reserves the right to replace any prize or a component of any prize with an alternative prize or component of any prize of equal or higher value if circumstances beyond the Promoter’s control make it necessary to do so.

  15. The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.

  16. The Promoter must either publish or make available information that indicates that a valid award took place in compliance with 8.28.5 of the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing. To comply with this obligation, the Promoter will tag the 5 winners on an Instagram post, posted by the @simbasleep Instagram account. The winners must reply to the direct message with their full name and UK delivery address for their prize, as the Promoter must provide the information and winning entry to the Advertising Standards Authority on request. This is in the Promoter’s legitimate business interests under the UK GDPR/DPA.

  17. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry or refuse to award a prize to anyone in breach of, or suspected of being in breach of, these terms and conditions.

  18. The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so.

  19. Insofar as is permitted by law, the Promoter or its agents or third party delivery service p roviders, will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Simba, its agents or distributors or that of their employees. Your statutory rights are not affected.

  20. Entries and the component parts thereof shall, to the extent permissible by law, become the property of the Promoter and may be used for marketing or promotional purposes.

  21. Personal data supplied during the course of this promotion will only be processed to facilitate the award of the prize (Your personal information will be shared with our delivery partners), and our compliance with the requirements of this prize draw (Delivery information will be kept securely in our system as proof of delivery), and other purposes permitted under the UK GDPR/DPA. See also condition 17 with regard to the announcement of winners.

  22. These terms and conditions and this promotion are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in England.
