New Year Sale Terms & Conditions 2025

1.0 New Year Sale Promotion Terms and Conditions 2025  

1.1 This Promotion (Simba New Year Sale) is subject to these Simba New Year Sale Terms and Conditions (NY25 Terms), promoted by Simba Sleep Limited, UK company 9703422 (Simba), and these NY25 Terms are subject to the overarching terms and definitions set out in Simba's general Terms document set out at www.simbasleep.com/pages/terms/ (Simba General Terms), including, but not limited to, the application of Collective Discounts where applicable.     
    
1.2 To the extent that the definition and the application of a Third Party Offer in these NY25 Terms conflict with the Simba General Terms in respect of combining promotional savings or discounts only, these NY25 Terms prevail.    

1.2.1 To the extent that a Joint Promoter Terms Document conflicts with these Simba NY25 Terms in respect of a discount or savings level offered pursuant to a Collective Discount only, the discount or savings level in the Joint Promoter Terms Document prevails. This is distinct from any conflict in respect of the Products or Bundles to which a Collective Discount may be applied.    

1.3 In these NY25 Terms, the following defined terms are used;   

1.3.1 All capitalised terms defined in the Simba General Terms appearing in these NY25 Terms have the meanings as defined therein.    

1.3.2 Promotional Window – means the limited time from 00:01 GMT on 27/12/2025 to 23:59 GMT on 05/01/2026 only.    

1.3.3 Promotional Price, and Promotional Pricing – means the offer price, and the offer pricing, respectively, for Products offered on the Website during the Promotional Window subject to this Promotion.    

1.3.4 Typical Price, and Typical Pricing – means the typical price, and the typical pricing respectively, for Products of various lines and models offered on the Website during the Typical Pricing Window.    

1.3.5 Typical Pricing Window – means a period prior to the Promotional Window during which Typical Pricing was offered on the Website, commencing on 02/12/2025 and concluding on 26/12/2025.    

1.3.6 Joint Promoter – means entities trading as GoCertify, Blue Light Card, Jointnetwork, Myvouchercodes NHS, Vouchercodes NHS, Student Beans, UNIDAYS, Totum, Save the Students, and Defence Discount Service, each of which offer a Third Party Offer which is available to Consumer Group members eligible for Collective Discounts under the Simba General Terms.    

1.3.6.1 Joint Promoter Terms Document – means the document setting out specific additional terms pursuant to which a Joint Promoter and Simba may offer to members of a Consumer Group an Extra Offer, as displayed on the Joint Promoter’s website, or via “widget” or other integrations linked out from our Website as applicable.    

1.3.7 Extra Offer – means various promotional offers which may be available to You, as set out in a Joint Promoter Terms Document, if You are a member of a Consumer Group eligible for a Collective Discount under the Simba General Terms through one of the Joint Promoters listed in these NY25 Terms subject and pursuant to the relevant promotional offer terms which the respective Joint Promoters advance via their websites or “widget” or other integrations on our Website as applicable, which specifically reference a Third Party Offer Exemption which must be included in our Website’s operating promotional terms and conditions as distinct from being mentioned in the Simba General Terms.    

1.3.8 Selected Mattresses – Cot bed mattresses, Kids Bunk, Essential, Hybrid, Pro, Luxe, Ultra, Source, Escape, Apex, Hybrid Topper and Hybrid Essential Topper line mattress Products, other than refurbished mattresses from those lines, are Selected Mattresses, but Selected Mattresses do not include any individual or group of such Products subject to an additional exclusion in term 1.3.8.1.    

1.3.8.1 The following additional mattress Products identified by the letter designations which follow are excluded from the definition of a Selected Mattress. (a) All Natural Hybrid Source Mattresses in size Single. 

1.3.10 Selected Beds – Camden, Wilmslow, Ludlow, Didsbury, Hebden, Hoxton, Portobello, Melrose, Kelham, St Ives, Sherwood, Ashdown, and Combe line bed Products, other than refurbished Products from those lines, are Selected Beds.    

1.3.10.1 The following bed Products identified by the letter designations which follow are excluded from the definition of a Selected Bed. (a) All Hebden Beds in Size Single. (b) All Hoxton Beds in Size Single. (c) All Blenheim Beds in size Double). (d) All Blenheim beds in size King. (e) All Combe Beds in size King. (f) All Kelham beds in size Single. (g) All Kelham beds in size Double. (h) All Portobello beds in size Single. (h) All St Ives beds in size Single. (i) All St Ives beds in size Double. (j) All St Ives beds in size Super King. (k) All Ludlow beds in size Single. (l) All Camden beds in size Single. (m) All Hoxton beds in size Super King. (n) All Wilmslow beds in size Single. (o) All Melrose beds in size Single. (p) All Didsbury beds in size Single. 

    
1.3.11 Selected Duvets – Hybrid®, Hybrid® 3-in-1 and Summer Hybrid® Duvet Products, other than refurbished Products, are Selected Duvets.    

1.3.11.1 The following Duvet Products identified by the letter designations which follow are excluded from the definition of Selected Duvet. (a) All Summer Hybrid Duvets in size Single. 

 
1.3.12 Selected Pillows – Hybrid®, CustomFlex Pillows and Body Pillow Products, other than refurbished Products, are Selected Pillows.    

1.3.13 Selected Mattress Protectors – Performance Mattress Protectors other than refurbished Products, are Selected Mattress Protectors    

1.3.13.1 The following Mattress Protector Products identified by the letter designations which follow are excluded from the definition of Selected Accessories. (a) All Mattress Protectors in size EU Single. 

1.3.14 Selected Slippers  – Rok Slippers and Stormur Slippers Products, other than refurbished Products, are Selected Slippers.    

1.3.14.1 The following Slipper Products identified by the letter designations which follow are excluded from the definition of Selected Slippers. (a) All YLUR slippers. 

 
1.3.15 Bundle – means a pre-configured or user-selected group of 2 or more Products offered on the Website which, when purchased concurrently, are offered at a combined price.    

    
1.3.16  Bundle Discount – means a price reduction applicable to the combined price of Products sold as new, discounted on a combined basis compared with their Typical Pricing Window prices when purchased separately.    

1.3.17 Example Discount or Saving - an example of a cash or percentage discount or saving in respect of a given Example Product, or Example Bundle, or a broader Savings Claim defined in this term 1.3.15’s subterms, which is referred to in assets displayed on or off the Website proximate to a symbol, and in some instances, proximate to both a shared symbol and a particular configuration name Descriptor, as defined in the relevant term.    

1.3.17.1 Example Product – a particular defined Product configuration in respect of which an Example Discount or Saving applies and which is explained in respect of each Example Product at term 2.5 and the subterms thereof which explain the relevant symbols.    

1.3.17.2 Example Bundle – a particular defined Bundle configuration in respect of which an Example Discount or Saving applies and which is explained in respect of each Example Bundle at term 2.6 and the subterms thereof which explain the relevant symbols.    

1.3.16.3 Savings Claim – a claim made on the basis which is explained in term 2.7 and the sub-terms thereof which explain the relevant symbols, which is calculated based on Savings Claim Examples as therein defined and explained.    

1.4 To ensure wide ranging availability of our Products to as many consumers as possible during the course of the Simba New Year Sale promotion, and without limiting our other options under the Simba General Terms, where what Simba regards to be excessive quantities of Products of not dissimilar specification are ordered in one order, or across multiple orders using contact, payment, and/or delivery information in common across those multiple orders, then without notice, Simba may refuse any such order or orders, or Simba may decline to fulfil such order or orders.    

1.5 For the avoidance of ambiguity, no refurbished Products are offered at any savings or discount of any type in the NY25 sale.    

1.6 For the avoidance of doubt, all discount and savings claims referenced in these NY25 Terms apply only to new Products and not to refurbished stock.    
    
2.0 What promotional discounts are available during Promotional Window and how are these displayed on the Website and elsewhere?    

2.1 During the Simba New Year Sale promotion, various reductions to the price of certain Products comparing the Promotional Price of those products with the Typical Price of those Products will apply, as set out in term 3 below.    

2.2 The Promotional Prices will be displayed on the Website during the Promotional Window.    

2.2.1 In conjunction with the Promotional Pricing or otherwise, Typical Pricing for Products of not dissimilar specification may also be displayed, whether on a strike through basis or otherwise, on the Website during the Promotional Window for comparison purposes.    

2.3 The Promotional Prices apply when You purchase individual Products offered on the Website subject to certain terms and conditions.    

2.4 Any “up to” saving or discount advertised for a Product or a group of Products whether in a Bundle or not, on an asset appearing on or off the Website, may be lower than the absolute maximum saving or discount available for certain Products within a relevant line, range, or model during the Simba New Year Sale promotion.    

2.5 Particular examples of discounts and savings applicable under term 3’s sub terms for a specific configuration of a particular Example Product may be referred to on the Website and/or in assets which refer to the Website externally marked with a particular symbol, which displays the associated Example Discount or Saving, with specific details particularised under this term 2.5’s subterms.    

2.5.1 A saving or discount of £539 proximate to the symbol “††” refers to the Luxe model mattress Product in size King bought on an individual basis. This Example Product is offered on the Website during the Promotional Window on an individual basis at a Promotional Price of £1,259.30. The Promotional Price of this Example Product offering equates to a saving or discount of £539.70 comprising this Example Product’s Example Discount or Saving, and that saving is based on a comparison of the Promotional Price with the Typical Price of £1,799.00 in respect of this Example Product offered on the Website and sold to consumers on the basis described during the Typical Pricing Window.    

2.5.2 A saving or discount of £958 proximate to the symbol “††” refers to the Super King Ultra Mattress Bundle comprising a Super King Ultra Mattress, 2 Hybrid Pillows and 1 Hybrid Duvet. Full price £3,276; Promotional Price £2,317.05; total saving £958.95.    

2.5.3 A saving or discount of £1,089 proximate to the symbol “††” refers to the Super King Ultra Mattress and Camden Ottoman Bed Bundle (standard colour and foot). Full price £4,048; Promotional Price £2,958.50; total saving £1,089.50.    

2.6 Particular examples of discounts and savings applicable under term 3’s sub terms for a specific configuration of a particular Example Bundle may be referred to on the Website and/or in assets which refer to the Website externally marked with a particular symbol, which displays the associated Example Discount or Saving, with specific details particularised under this term 2.6’s subterms.    

2.7 Particular examples of discounts and savings applicable to a Savings Claim may be referred to on the Website and/or in assets which refer to the Website externally marked with a particular symbol, which displays the associated Example Discount or Saving, with specific details particularised under this term 2.7’s subterms.    

5.1.2.3 Adjust pricing on any Bundle where a component Product in that Bundle may no longer be offered at a discount during the Promotional Window, in which circumstances, the price of a Bundle containing that component Product will be increased by the difference between that individual Product’s ceased Promotional Pricing, and that individual Product’s Typical Pricing Window Pricing.     

5.1.2.4 Correct or clarify typographical or drafting errors in these NY25 Terms. In such cases, Simba may append a notation to these NY25 Terms, specifying the date of the correction or clarification.    

5.2 Simba may take any action under Section 5.1 and its subterms in the following circumstances:    

5.2.1 When acting not otherwise than in accordance with its legitimate business interests.    

5.2.2 If Simba is, or suspects it may be, unable to administer the Simba New Year Sale or Collective Discounts which are distinct discounts and savings from savings set out for members of the general public per the Simba New Year Sale, the Simba General Terms, or any Joint Promoter Terms Document; and/or    

5.2.3 When required to do so by law or regulatory compliance obligations.    

5.3 In any instance where Simba exercises its rights under terms 5.1 or 5.2 or their sub-terms of these NY25 Terms resulting in your or another person’s inability to access any offer in the Simba New Year Sale or any Extra Offer, Simba will have no liability to you or any other person.    
    
6.0 Important information about Joint Promoters and Extra Offers.    

6.1 Joint Promoters may advance certain Extra Offers to You via various channels, subject to Joint Promoter Terms Documents, which interact with, and must be interpreted in conjunction with, these NY25 Terms and the Simba General Terms.    

6.2 As not all users of the Website or other media are members of Consumer Groups, specific comparisons of pricing for savings and discounts, or savings and discounts more generally applicable during the Promotional Window which may be available to Consumer Group members during the Promotional Window under a distinct Extra Offer may not be displayed on the Website or in other media. You must note this when seeking to use any Extra Offer.    

6.3 If You have an eligibility query about an Extra Offer based on a Consumer Group matter, You must contact the relevant Joint Promoter in the first instance.
