November 2024 Customer Survey Information

We, Simba Sleep Limited (UK company Number 09703422), are inviting selected customers who previously purchased certain products from us to complete specific online surveys to help us better understand our different customers’ views on certain products, and their journeys in selecting and purchasing sleep products through market research, each being one of a number of “November 2024 Customer Surveys” being conducted by Simba Sleep Limited (“Simba”).  

All respondents to any of the the November 2024 Customer Surveys will be entered into a competition draw with other respondents to the various November 2024 Customer Surveys to win a Simba mattress or bed of their choice (the “November 2024 Customer Surveys Promotion”, or the “Promotion”), and by submitting a response to any of the November 2024 Customer Surveys, you accept, and agree to being bound by, the terms of the Promotion as set out below.

The URLs for the November 2024 Customer Surveys vary depending on the product in respect of which Simba has sent you an invitation. Please refer to the email you received from Simba for further information about the specific product in respect of which Simba has sent you a survey. 

Terms and Conditions – November 2024 Customer Surveys Promotion Terms (ST V1) 

  1. The prize draw and process surrounding the prize draw which constitutes this Promotion is subject to these terms and conditions (“November 2024 Customer Surveys Promotion Terms”), and Simba (meaning Simba Sleep Limited, UK company Number 09703422, registered office address 5th Floor, Halo, Counterslip, Bristol, BS1 6AJ) is the Promoter of this Promotion. 
  2. The Promotion and these November 2024 Customer Surveys Promotion Terms are subject to Simba’s general Terms, accessible at https://simbasleep.com/pages/terms/, and Simba’s Privacy Policy, accessible at https://simbasleep.com/pages/privacy/ (collectively, these are the “Simba Website Documents”).  
  3. The prize draw is free to enter, and no purchase is necessary. The prize draw is open to all UK residents aged 18 years or over who were invited by Simba to complete one of the November 2024 Customer Surveys, except employees of Simba, their families, agents or any third party directly associated with administration of the prize draw, or where the offer of this prize draw is otherwise prohibited.  
  4. All submissions to any of the November 2024 Customer Surveys, each being an entry to the November 2024 Customer Surveys Promotion prize draw, must be submitted by visiting a specific URL depending on the product to which the given November 2024 Customer Survey relates, following an emailed invitation from Simba.  
  5. The opening date for entries for the November 2024 Customer Surveys Promotion prize draw is 6pm GMT on Monday 25th November 2024. The closing date for entries for the prize draw is 11.59pm GMT on Saturday 30th November 2024. Entries received after this time will not be valid. 
  6. Simba accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network, or server failure of any kind. 
  7. The use of any script, macro or any not dissimilar automated system or method, to enter the Promotion, is prohibited, and entries made (or which, in Simba’s opinion and determined at Simba’s sole discretion, appear to have been made) using any such script, macro or automated system or method, may be treated as void at Simba’s sole discretion. Any illegible, incomplete, or fraudulent entries may be rejected or held to be void. 
  8. A single Winner will be chosen from all entrants to the November 2024 Customer Surveys Promotion, being all November 2024 Customer Survey respondents’ entries, by random draw performed by a computer process on or around 2nd December 2024. 
  9. The Prize is a bed or mattress of the Winner’s choice available on simbasleep.com in the 30 days following the award of the Prize. The Winner will receive a code to redeem on Simbasleep.com for a bed or mattress of their choosing as offered on Simbasleep.com, to be delivered to an address in the UK without any cost to the Winner. 
  10. The Winner will be notified via contact via email on or around 2nd December 2024 and must confirm that they accept the Prize in writing.  
  11. If the Winner does not respond to Simba within 3 days of being notified by Simba, then the Prize will be forfeited by that Winner, and Simba will be entitled to select another Winner in accordance with the process described in condition 8. 
  12. Entrants may only submit one entry to the Promotion, other than where a particular option is offered during the course of the survey for a “double entry”. This includes, but is not limited to, meaning that entrants may submit no more than one entry overall across the multiple November 2024 Customer Surveys generally, and that entrants may submit only one entry in one of the November 2024 Customer Survey in particular. If Simba determines that any entrant has submitted more than one entry to the Promotion, whether such determination is made before or after a prize draw, Simba reserves the right to regard all of that entrant’s entries as invalid. Simba will only invite any previous customer to complete one of the November 2024 Customer Surveys.   13. The Prize for the Winner is non-exchangeable and non-transferable, and no cash alternative is offered. 
  14. Despite condition 13, Simba reserves the right to replace the Prize with an alternative prize of equal or higher value, or, and at Simba’s absolute sole discretion, the cash value of the relevant prize, if circumstances beyond Simba’s control makes it necessary to do so. 
  15. The decision of Simba regarding any aspect of the prize draw or administration of the Promotion is final and binding and no correspondence will be entered into about it. 
  16. Simba must either publish or make available information that indicates that a valid prize award took place. To comply with this obligation the Simba will send the surname and county of the Winner to any person who writes to Simba’s registered office address (enclosing a self-addressed envelope) within one month after the closing date set out in condition 5. If you object to any or all of your surname, county and winning entry being published or made available, please get in touch with Simba via hello@simbasleep.com. In such circumstances, Simba must still provide the information and winning entry to the Advertising Standards Authority on request. 
  17. Simba reserves the right to hold void, cancel, suspend, or amend the Promotion where it becomes necessary to do so, and/or to refuse any entry, or to refuse to award a prize to any person suspected of acting otherwise than in accordance with the November 2024 Customer Surveys Promotion Terms. 
  18. These November 2024 Customer Surveys Promotion Terms must be read in conjunction with the Simba general Simba Website Documents, as these November 2024 Customer Surveys Promotion Terms and information submitted in response to each of the November 2024 Customer Surveys are processed pursuant to both the Simba Website Documents. 
  19. In the event of any conflict between these November 2024 Customer Surveys Promotion Terms and either of the Simba Website Documents, the Simba Website Documents shall take precedence over these November 2024 Customer Surveys Promotion Terms.  
  20. Simba, its agents, or distributors will not in any circumstances be responsible or liable to compensate any Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Simba, its agents or distributors or that of their employees. Your statutory rights are not affected. 
  21. Whether or not an entry to the Promotion is valid or you are eligible to enter, personal data supplied and any consents collected during any entrants’ entry into the Promotion will be collected and processed on the basis of consent, so that Simba may conduct the Promotion (including to validate that a Winner was invited to respond to one of the November 2024 Customer Surveys and to facilitate the award of the prize to the Winner), and for the furtherance of Simba’s market research and business development activities as set out in the Simba Website Documents, and with regard to the announcement of the Winners as per condition 16 to allow Simba to fulfill its obligation to evidence that the valid award of the Prize took place. 
  22. These November 2024 Customer Surveys Promotion Terms and the Promotion itself are each governed by English law. 
  23. If any entrants to this Promotion wish to take court proceedings, then they must do this within the courts of England and Wales.
