EARTH RANGE FEEDBACK

REVIEW TERMS 
The Earth Range Feedback Promotion (the “Promotion”) is promoted by Simba Sleep Limited (Company Number 09703422) of 5th Floor, Halo, Counterslip, Bristol, BS1 6AJ ("Simba”). Our VAT number is GB230194343.  
 
These Earth Range Feedback Promotion Terms (the “Terms” of the Promotion specifically) are subject to the overarching terms and definitions set out in of Simba's general Terms document set out at www.simbasleep.com/pages/terms/ (Simba General Terms). These Earth Range Feedback Promotion Terms import terms and meanings defined and capitalised in the Simba General Terms. 
Participants who purchase a Simba Earth Range mattress product from the Website, leave a short review of the product either on the Website directly or via Yotpo, will receive a coupon code (the “Code”) to claim one free Simba Hybrid Pillow (the “Offer”). The Offer and the Promotion are subject to the Terms set out below.

These Terms apply to the Offer and the Promotion and are applicable to individuals who participate in the Offer and/or enter the Promotion (“Participant" or “Participants”). 
These Earth Range Feedback Review Promotion Terms are effective from 02 October 2024. 
 These Terms and this Offer are distinct from other terms, offers, and promotions (or competitions) available on the Website.  
By participating in the Offer, Participants agree to be bound by these Terms. Promotional materials relating to the Offer and Promotion, including all information on how to redeem or enter also form part of these Terms. In the event of any conflict between any term referred to in such promotional materials and these Terms, these Terms shall take precedence. In the event of any conflict between any term in these Terms and the Simba General Terms, the Simba General Terms take shall take precedence. 

The Offer Terms 

1. This Offer is valid from  02nd October 2024, until 23:59 GMT on 31st December 2024, or until such time as it is withdrawn by Simba at its discretion, which may be at any time (the “Offer Window”). After Simba has withdrawn the Offer, it may no longer be redeemed.  

2. Eligibility 
To redeem the Offer, the Participant must: 
i. Be aged at least 18 years old; 
ii. Be legally resident within the United Kingdom; 
iii. Not be an employee or agent of Simba or any of its group, subsidiary, or affiliated companies, or their immediate families or members of their households, or otherwise connected with the operation or fulfilment of the Promotion. 
iv. Receive an invitation from Simba to provide a review of their previous Earth Range mattress product purchase via the Website within the Offer Window; and 
v. Submit a review of one or more of the purchased Earth Range mattress products on the Website and/or via Yotpo (the “Review”). A link to the review submission page will be emailed to the Participant following their purchase and may be resent upon request. The Participant acknowledges that any review left by them on the Website or via Yotpo is subject to the applicable terms of service and jurisdiction of any such site or platform and that they will continue to be bound by such terms. 

3. Participants may only submit one review per product purchased. Where multiple reviews are detected by Simba in respect of the same product by one Participant, Simba will not award any additional Code. Simba will not be obliged to award the Code to a Participant who submits the multiple reviews. 

4. Where the participant will have complied with the requirements at clause 2, the Participant will receive a unique Code via email that entitles them to claim one free Simba Hybrid Pillow with a value of £109 at full price (as of 02 October 2024)  via the Website. The pillow must be added to the basket and the unique Code entered at checkout for the Offer to apply. This Code should be provided within 24 hours of submitting the review.

6.The Code sent to the Participant pursuant to this Offer is subject to the following limitations: 
i. The Code can only be used to obtain one (1) free Simba Hybrid Pillow via the Website;
ii. The Code may only be used until 23:59 GMT on 31st December 2024.
iii. The Code is non-transferable, cannot be exchanged for cash or any other alternative, and cannot be combined with other promotions or offers ;
iv. Only one Code will be provided in respect of any Earth range mattress Product reviewed by a participant. ; 

7. Simba reserves the right to refuse to honour the Code given under this Offer where the  Participant seeks to use any Codes otherwise than in accordance with clause 6. 

8. Simba reserves the right not to honour this Offer or a particular Code in any circumstances it considers appropriate, including without limitation: 
i. Where the Participant seeks to redeem the Offer before commencement or after the expiry of the Offer Window; 
ii. Where the Participant seeks to redeem the Offer in conjunction with any other Code, discount code, offer, promotion, bundle or other similar scheme. 
iii. The Code is non-transferable, cannot be exchanged for cash or any other alternative, and cannot be combined with other promotions or offers. 

9. This Offer may not be used in conjunction with any other Coupon code, discount code, offer, promotion, bundle or other not dissimilar mechanism, including but not limited to via any affiliate discount code. Simba reserves the right to refuse to apply any and all coupon codes, discount codes, offers, promotions, bundles or other not-dissimilar mechanisms during the Offer Window at its absolute and sole discretion and will have no liability to the customer when exercising this right.  

10. Simba reserves the right to cancel, amend or withdraw this Offer at any time where it considers it appropriate to do so, or where it is prevented from administering the Offer in accordance with these Terms and Conditions.  

11. This Offer applies to Simba Products ordered for delivery in the UK and via the Website only. For the avoidance of doubt, this Offer cannot be applied to products purchased via any of Simba’s authorised retailers, or any other merchant or website.  

12. This Offer applies to Simba Products ordered for delivery in the UK and via the Website only. Refer to the Simba General Terms for potential exclusions. 

13. If a Code has not been sent within 24 hours, and the Participant believes they have complied with these Terms, or they have any other questions or issues in relation to the Offer, they must contact Simba via hello@simbasleep.com. 

14. By redeeming the Offer, the Participant irrevocably agrees that their review may be used in Simba’s promotional, advertising or marketing material and otherwise in accordance with the terms of Simba’s designated third-party review websites, and hereby grant Simba and Simba’s designated third-party review websites a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license for Simba to do the same.   
 
15. There may be multiple Codes sent to Participants, where Participants have purchased more than one Earth mattress Product. The Simba Hybrid Pillow is as stated and is non-exchangeable and non-transferable by any Participant. By participating in the Promotion, Participants agree that the Offer is awarded on an "as is" basis, and that neither Simba nor any of its subsidiary or affiliated companies make any representations or warranties of any nature with respect to the Offer. 
 
16. If the Participant does not redeem the Offer by 31st December 2024, the Offer will be forfeited. 
 
17. Simba reserves the right to modify, cancel, terminate, or suspend the Offer at any time if it believes the Offer is not capable of being conducted as specified within these Terms, including in cases of unauthorized human intervention, technical failures, or circumstances beyond Simba’s control. 
 
18. Simba will not be responsible for any expense, cost, loss, or damage that results from participants' entry into the Promotion or their acceptance and/or use of the Code. 
 
19. These Terms are governed by English law. The courts of England and Wales shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Promotion or these Terms.
