Cyber Monday Low Price Day Promotion Terms and Conditions

1.1 This Promotion (Cyber Monday Low Price Day Promotion) is subject to these Cyber Monday Low Price Day Terms and Conditions (Cyber Monday Low Price Day Terms), promoted by Simba Sleep Limited, UK company 9703422 (Simba), and these Cyber Monday Low Price Day Terms are subject to the overarching terms and definitions set out in of Simba's general Terms set out at www.simbasleep.com/pages/terms/ (Simba General Terms), including, but not limited to, the application of Collective Discounts where applicable.

1.2 In these Cyber Monday Low Price Day Terms, the following defined terms are used;

1.2.1 All capitalised terms defined in the Simba General Terms appearing in these Cyber Monday Low Price Day Terms have the meanings as defined therein.

1.2.2 Offer Window – means the limited time between 00:01 GMT on 02/12/2024, to 23:59 GMT on 02/12/2024 only.

1.2.2.1 For the avoidance of ambiguity, the Promotion begins and ends during the course of the same single day, on Monday, 02/12/2024.

1.2.3 Low Cyber Monday Pricing – means the pricing displayed on the Website in respect of Selected Products during the Offer Window.

1.2.4 Selected Products include the following groups of products described under each of their respective categories in this term 1.2.4’s subterms.

1.2.4.1 Selected Mattresses – Essential, Comfort (also known as Hybrid Original), Pro, Luxe, Ultra, Source, Escape, Apex line mattress Products, other than refurbished mattresses from those lines, are Selected Mattresses.

1.2.4.1.1 For the avoidance of ambiguity, Cot Bed Mattress Products and Kids Mattress Products are excluded from the definition of a Selected Mattress.

1.2.4.2 Selected Beds – Camden, Wilmslow, Ludlow, Didsbury, Hebden, Hoxton, Portobello, Melrose, Kelham, St Ives, Sherwood, Ashdown, and Combe line bed Products, other than refurbished Products from those lines, are Selected Beds.

1.2.4.3 Selected Duvets – Hybrid® Duvet Products, Hybrid® 3-in-1 Duvet Products, and Summer Hybrid® Duvet Products, other than refurbished Products from those lines, are Selected Duvets.

1.2.4.4 Selected Pillows – Hybrid® Pillow, Hybrid® Firm Pillow, Body Pillow other than refurbished Products from those lines, are Selected Pillows.

1.2.5 Joint Promoter – means entities trading as GoCertify, Blue Light Card, Jointnetwork, Myvouchercodes NHS, Vouchercodes NHS, Student Beans, UNIDAYS, Totum, Save the Students, and Defence Discount Service, each of which offer a Third Party Offer which is available to Consumer Group members eligible for Collective Discounts under the Simba General Terms.

1.2.6 Joint Promoter Terms Document – means any document setting out specific additional terms pursuant to which a Joint Promoter and Simba may offer to members of a Consumer Group an Extra Offer, as displayed on the Joint Promoter’s website, or via “widget” or other integrations linked out from our Website as applicable.

1.3 To the extent that the definition and the application of a Third Party Offer in these Cyber Monday Low Price Day Terms conflict with the Simba General Terms in respect of combining promotional redemptions, these Cyber Monday Low Price Day Terms prevail.

1.3.1 To the extent that a Joint Promoter Terms Document conflicts with these Cyber Monday Low Price Day Terms in respect of a discount or savings offered pursuant to a Collective Discount only, the discount or savings level in the Joint Promoter Terms Document prevails where higher than as provided for in subterm 3.1.2.1.

1.3.1.1 The conflict resolution provision in clause 1.3.1 is distinct from any conflict in respect of the Products listed in a Joint Promoter Terms Document which indicates to which Products a Collective Discount may be applied.

1.4 To ensure wide ranging availability of our Products to as many consumers as possible during the course of the Promotion, and without limiting our other options under the Simba General Terms, where what Simba regards to be excessive quantities of Products of not dissimilar specification are ordered in one order, or across multiple orders using contact, payment, and/or delivery information in common across those multiple orders, then without notice, Simba may refuse any such order or orders, or Simba may decline to fulfill such order or orders.

How is Low Cyber Monday Pricing displayed on the Website?

2.1 During the Offer Window, Low Cyber Monday Pricing is displayed on the Website in respect of all Selected Products.

2.2 To redeem the offers of Low Cyber Monday Pricing Pricing for Selected Products under the Cyber Monday Low Price Day Promotion, You add items to your cart and checkout during the Offer Window.

What are the conditions and exclusions applicable to the Promotion?

3.1 Other than an Extra Offer, any other promotion, discount, or offer cannot be combined with the Cyber Monday Low Price Day Promotion unless expressly permitted by this term 3.1’s subterms.  

3.1.1 These Cyber Monday Low Price Day Terms allow an Extra Offer as defined in these Cyber Monday Low Price Day Terms to be used during the Cyber Monday Low Price Day Promotion subject to the specific terms and any other exclusions or limitations applicable to an Extra Offer offered by a Joint Promoter listed in these Cyber Monday Low Price Day Terms.

3.1.2 The discount or saving against the Low Cyber Monday Pricing in redeeming any Extra Offer will amount to a discount or saving depending on the Website’s Low Cyber Monday Pricing in respect of a given Selected Product or Selected Products, and the redemption of this Extra Offer discount additionally depends on the specific terms set out in the relevant Simba and Joint Promoter’s Joint Promoter Terms Document, as well as the Simba General Terms.

3.1.2.1 An Extra Offer of 2% off the Low Cyber Monday Pricing applies for Selected Products, unless the relevant Joint Promoter Terms Document applicable indicates otherwise.

3.1.2.1.1 By way of worked example under term 3.1.2.1, a Selected Product offered to the general public at Low Cyber Monday Pricing of £200.00 is discounted by £4.00 as separate and superseding  2% saving or discount applied in respect of an Extra Offer, unless the relevant Joint Promoter’s Joint Promoter Terms Document applicable indicates otherwise.

3.1.3 Redemption of any Extra Offer entirely supersedes the Low Cyber Monday Pricing more generally offered to the general public under the Promotion for those members of Consumer Groups who redeem Collective Discounts.

3.2 The Low Cyber Monday Pricing under the Promotion is offered only in respect of purchases of Selected Products made available for purchase by consumers via the Simba Website, and for delivery to an address in the UK only, and where available, pursuant to the Simba General Terms.

In what situations may Simba adjust or end the Promotion?

5.1 The Cyber Monday Low Price Day Promotion is offered pursuant to Simba’s good will and is offered only for so long as Simba elects to offer it or any element of it, and contingent on Simba being in compliance with, and remaining compliant with, legal and other obligations.

5.1.1 Simba reserves the right to take any action whatsoever in respect of the Cyber Monday Low Price Day Promotion where Simba considers that it is appropriate to do so.

5.1.2 By way of non-exhaustive examples, Simba reserves the right to cancel, adjust, amend, or withdraw at any time and without notice;

5.1.2.1 this Promotion in its entirety; or

5.1.2.2 availability of any Selected Product whether in part or in full; or

5.1.2.3 correct or clarify typographical or drafting errors, in which circumstances a notation will be added to these Cyber Monday Low Price Day Terms following the final term to note the date of the correction or clarification.

5.2 Simba may elect to act under term 5.1 and the subterms thereof in any circumstances, including, but not limited to, in circumstances where Simba;

5.2.1  has regard to its legitimate business interests; or

5.2.2   is, or suspects Simba may be, prevented from administering this Promotion or any component of it in accordance with these Cyber Monday Low Price Day Terms, or the Simba General Terms; or

5.2.3 is required to do so owing to a compliance or legal obligation.

5.3 Where Simba takes or omits to take any action under either or any of term 5.1 or 5.2 resulting in your inability to access any offer under the Promotion per the Cyber Monday Low Price Day Terms, Simba shall have no liability to You.
