The Bed Show Competition 2024 T&Cs

1. The Promoter 

1.1 The promoter is Simba Sleep Limited of 5th floor, Halo, Counterslip, Bristol, BS1 6AJ, United Kingdom. 

1. 1.2 The title of the competition is “The Simba x Bed Show Nanocube® Competition”.  

1.3  The competition mechanic is as follows: entrants guess the number of Nanocubes® in the jar which will be on display at the Simba Sleep stand during the Bed Show. The closest guess wins a Simba Ultra Hybrid® Sleep Bundle worth up to £3,776, (Based on a Super King size Hybrid(R) Ultra Mattress, 2 x Hybrid(R) Pillows and 1 x Hybrid(R) Duvet). The closest guess will win. In case of a tie (whether by two entrants guessing the same correct number, or two entrants being within the same number of Nanocubes® while being incorrect, a random draw completed via a computer process will be used to determine the winner. 

1. How to enter 

1. 2.1 The competition will commence at 9:00 am BTS on 24th of September 2024 (the "Opening Date") to 4:00 pm BTS on 25th of September (the "Closing Date") inclusive. 

2.2 All competition entries must be received by the Promoter via a Typeform entry form, which must be completed on a Simba furnished device at the Simba Stand, by no later than 4:00 pm on the Closing Date.  

2.3 All competition entries received after the Closing Date are automatically disqualified. 

 2.4 To enter the competition, entrants must: 

2.4.1 Provide their full and correct details via the Typeform on the Simba provided device at the Simba Stand with the support of one of the Simba Sleep personnel located at the Simba stand. 

2.4.2 Complete the Typeform entry form available at the Simba Sleep stand Located at Telford International Centre International Way, Telford TF3 4JH, The Bed Show exhibition Simba Sleep Stand. 

2.4.3 No purchase is necessary for entry.  

2.4.4 Only one entry per person is permitted.  

1. 2.5 The Promoter will not accept responsibility for competition entries that are lost, mislaid, damaged, or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind. 

2.6 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

2.8 The jar of Nanocubes®’ contents have been counted prior to the commencement of the The Simba x Bed Show Nanocube® Competition.  

1. 3.      Eligibility 

3.1 The competition is only open to all residents in the UK aged 18 years or over attending the The Bed Show event, except: 

1. employees of the Promoter or its holding or subsidiary companies, or its licensees; 

1. employees of agents or suppliers of the Promoter or its holding or subsidiary companies or its licensees; or 

1. members of the immediate families or households of (a) and (b) above. 

3.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize.  

3.3 The Promoter may require you to provide proof that you are or were eligible to enter the competition by checking that the person whose entry has been drawn.  

3.4 The Promoter will not treat as valid any or, to the extent feasible, allow to be submitted, competition entries that are or are suspected to have been: 

1. a) automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);
2. b) completed by third parties or in bulk; or
3. c)

1. 3.5 There is a limit of one entry to the competition per ticket holder. 

3.6 Entries on behalf of another person will not be accepted and joint submissions are not allowed. 

3.7 The Promoter reserves the right to disqualify you if your conduct is contrary to the spirit or intention of the prize draw competition. 

1. 4.    The prize 

4.1 The prize is a Simba Ultra Hybrid® Sleep Bundle, comprising a Simba mattress, two Hybrid® Pillows, and a Hybrid® Duvet. The prize is worth up to £3,776.00 assuming a choice by the winner of the Hybrid® Ultra Mattress (Super King size) as a mattress, 2 x Hybrid® Pillows, and 1 x Hybrid® Duvet of Super King size based on the price of these items on the simbasleep.com website as displayed on 16 September 2024. 

1. 4.2 The prize is non-exchangeable and non-transferable, with no cash alternative.  

4.3 In the event that no entrant correctly selects the number of Nanocubes® contained within the jar, displayed at the Simba Sleep Stand, the winning entrant will be the guess which is closest to the actual number of Nanocubes®. In the of a tie, tied entrants for either the correct number of Nanocubes® or the closes number of Nanocubes® (whether higher or lower) the winner will be selected by a random computer process. Checks will be conducted to verify that the entry selected via such a process was eligible to enter and win the prize.  The prize is supplied by Simba Sleep Limited of 5th floor, Halo, Counterslip, Bristol, BS1 6AJ, United Kingdom (the "Promoter").  

4.4 The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.  

4.5 In order to claim the prize, you must follow the instructions outlined in clause 2.4 on how to enter the competition and be present at the Bed Show to claim the prize. 

5. Winners 

5.1 The winner will be selected based on the closest guess to the actual number of Nanocubes® in a Simba Hybrid® Pillow. 

5.2 Checks will be conducted to verify that the entry selected was eligible to win the prize. 

1. 5.3 The decision of the Promoter is final, and no correspondence or discussion will be entered into. 

1. 5.4 The winner will be selected on Friday 27th of September within 2 working days after the show ends by Wednesday, 25th September 2024, and the winner will be contacted on email by, 27th of September 2024.  

5.5 The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted. 

5.6 If the winner cannot be contacted within 3 working days of the announcement, the Promoter will move to the next closest guess made by an entrant up/down from the number of Nanocubes® and the process as herein described will be repeated until the Prize is awarded. Where multiple entrants were proximate to the correct guess, see 4.3. 

5.7 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter may send the surname and county of the Bed Show prize winner/winners to any person who writes to Simba’s registered office address (enclosing a self-addressed envelope) within one month after the close of the competition.  

5.8 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter via hello@simbasleep.com. In such circumstances, Simba must still provide the information and winning entry to the Advertising Standards Authority on request. his is in the Promoter’s legitimate business interests under the UK GDPR/DPA. 

6.      Claiming the prize 

6.1 If you are the winner of the prize, you will have 3 working days from the Announcement (date when contacted) Date to claim the prize by replaying with your delivery address and phone number . 
 

6.2 The prize may not be claimed by a third party on your behalf, nor may it be delivered to a third party you nominate. 

6.3 The Promoter does not accept any responsibility if you are not able to take up the prize. 

7.   Limitation of liability 

7.1  Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected. 

8.     Ownership of competition entries and intellectual property rights 

8.1 The Promoter does not claim any rights of ownership in your competition entry. 

8.2 By submitting your competition entry and any accompanying material, you agree to: 

1. a) assign absolutely to the Promoter all your intellectual property rights held in the competition entry with full title guarantee; and
2. b) waive absolutely all moral rights, in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
   
   9. Data protection General 

9.1 We are interpreting your interest in this competition as an interest in our products for business purposes, so we may contact you on a business to business basis using your business contact details which you supplied in the Typeform on an ongoing basis, unless and until you tell us to cease contacting you and/or to remove your contact information from our holdings. 

9.2 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition. 

9.3 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so. 

9.4 These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
