Terms & Conditions: Simba Sleep App Feedback

 
Simba Sleep has invited selected new users of the new Simba Sleep App to complete a survey to help us better understand the user experience (good or bad) of the new Simba Sleep App, to identify any issues and areas of improvement around the App to better improve the user experience.  

By completing the Survey, to say thanks, the Promoter offers those selected users of the Simba Sleep App contacted by Simba Sleep the option to enter a Prize Draw, the details and conditions of which are set out below. 

If you elect to participate in this survey, responses to the survey will not be associated with your email address. Your email address is used only to confirm your eligibility to enter the prize draw to win a Simba Hybrid® Original Mattress, and to contact you if you are the winner of the prize draw. 

Providing your email address and entering the draw to win a Simba Hybrid® Original Mattress does not give the Promoter consent to use your personal information for direct marketing purposes. 

Simba Sleep App Feedback Prize Draw Conditions 

1. The prize draw is open to UK residents aged 18 years or over, except employees of the Promoter, their families, agents or any third party directly associated with administration of the prize draw, who have been sent an invitation to complete the Simba Sleep App Feedback by the Promoter via email. 

Responding to the survey at https://simbaj.typeform.com/to/aUJyA0Oy automatically enters you into the Prize Draw. The prize draw is free to enter and no purchase is necessary. 

All entries must be submitted https://simbaj.typeform.com/to/aUJyA0Oy and only one entry per person is permitted. 

1. The opening date for entries is 10:30 BST on 7th October 2024. The closing date of the prize draw is 23:59 BST on 10th October 2024.  Entries received after this time will not be considered.  
2. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind. 
3. A winner will be chosen by random draw performed by a computer process on 11th October 2024 ("Draw Date"). 
4. The winner will receive one (1) Hybrid® Original Mattress of the size of the winner’s choosing 
5. The winner will be notified by email (using details provided at entry) before 15th October 2024 and must provide an address able to receive deliveries from the Promoter’s deliver providers (contact the Promoter via hello@simbasleep.com to confirm) to claim their prize. If a winner does not respond to the Promoter within 3 days of being notified by the Promoter, or does not provide complete information requested by the Promoter as set out in these Simba Sleep App Feedback Prize Draw Conditions, then the winner's prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above. 
6. The winner may be required to submit such identification or evidence of eligibility as may be specified by the Promoter to establish that they are the eligible (or not rendered ineligible, as the case may be) under condition 1 of these Simba Sleep App Feedback Prize Draw Conditions before the prize will be sent. 
7. The prize will be sent to the winner by post within 3 days of being notified of their win. 
8. The prize for the winner is non-exchangeable, non-transferable and no cash alternative is offered.  
9. The prize is supplied by the Promoter. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so. 
10. The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.  
11. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the first initial, surname, and county of the prize winner at https://simbasleep.com/pages/simba-competition-winners. If you object to any or all of your surname, first initial and county being made available as set out in this condition 14 of these Simba Sleep App Feedback Prize Draw Conditions, please contact the Promoter via hello@simbasleep.com. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request. 
12. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry or refuse to award the prize to anyone in breach of these terms and conditions.  
13. The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so. 
14. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected. 
15. The use of any script, macro, or any automated system, process, or method, to enter the prize draw, is prohibited, and entries made (or which, in the Promoter’s opinion and determined at the Promoter’s sole discretion, appear to have been made) using any such script, macro, or any automated system, process, or method, may be treated as void at the Promoter’s sole discretion. 
16. Personal data supplied during the course of this promotion is processed by consent of the entrant. Personal data will only be processed to facilitate the valid award of a prize, and to evidence the valid award of a prize - see condition 14 of these Simba Sleep App Feedback Prize Draw Conditions with regard to the announcement of the winner. 17. These terms and conditions and this promotion are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
